Totaled Car = Rates Increase

Hello first let me start with Im an ***...

...Now down to business. I caught a patch of ice and went flying off the road into a tree today, car is udderly and completely totaled. The tow bill is like 500, the cop didn't give me anything but a warning, he didn't even take my insurance info? I have a $1000 collision and $500 comp deductible. (I'm pretty sure a tree is collision) the car blue booked at about $4000. I wanna put it through insurance but here comes the tricky part.
the insurance is in my moms name, i'm not on the policy,
she lives in a different state and is driving a car that is under her husbands policy(my step-dad), her name is on his policy

I'm going to total the car either way cancel the insurance plan and start my own plan with a car i should be getting tomorrow. I'm hoping that I can use the insurance check for some of the bills (and i know i wont get it right away)

if i put a claim in with insurance company will his/her rates go up even though it was my incident? What if my mom had her own insurance plan? what if both my(my mom's) plan and step-dads plan are with the same company? the cop told me it is only going on my record as a warning, will affect my new insurance? also my work is strict about clean licenses should I be worried about the warning (the cop told me no)?

Insurance follows the car, not the driver. Generally you would be considered a
"permissive user" on the auto policy, however if you live in a different state and have the car in the new state this could potentially open up a new can of worms. It is possible (might not be likely, depending on the insurer) they could try to deny the claim altogether for misrepresentation on the policy.

Let's assume the insurance company pays the claim, because they probably will. Your mom's insurance is going to go up due to an at fault collision claim. The company she is with may allow her to exclude you from the policy to avoid that, depends on the company and their underwriting rules.

As for you... The next time you apply for insurance they are going to ask you if you have had any at fault accidents in the last x number of years. If you lie and tell them no then you are misrepresenting facts. Your rates will definitely be affected if you have an at fault accident on your record, no question. After 3 years or so those rates will not be impacted as much, or not at all.
