Vehicle Towed After Accident Due to Suspended License

I apologize if this was posted already but I have a question regarding a recent vehicle impound. I was involved in an accident in which the other driver was at fault (rear ended by semi) and my vehicle was towed because I had a suspended license (unpaid ticket). I have been in discussion with the other driver's insurance co. and was wondering if I had any possibility of recovering the fees associated with the tow and impound simply because the accident was caused by the truck. Any advice is greatly appreciated. Thanks

Depends.
If the car was towed because of the accident, then yes. If the car was drivable, but towed simply because of the suspended license, then not likely.

That said, I would assume the trucks insurance will pay the tow and reasonable impound (1 or 2 days). Drivable or not is frequently up to the driver, they don't usually sweat that so much. If 2 days later, you drove it off the impound lot, or there wasn't any significant damage done, then there might be a different outcome.

Here in a Texas, a few counties are starting to automatically tow your car if you're pulled over and have no insurance, and I wouldn't be surprised if they did the same for suspended licenses
 
Unfortunately, your license suspension had nothing to do with the claim. You shouldn't have been driving without a license. I wouldn't worry about the towing and spend much time on that. The insurance company could fight and say your claim is denied due to driving with a suspended license. Keep quiet and move forward with the claims process.
 
You will only get the money for the two if your car was NOT driveable due to the accident. If it was driveable and it was towed because your licensed was suspended then 99% chances are that the other insurance company won't pay for that.

It's an expense not related to the accident. Hope that helps and hope you get your licensed cleared up!
