Way Out of Non-Compete

The reason I want to leave the cluster, they wont let you write direct commercial stuff. They have to submit it. Sometimes it takes up to 4-5 days to get a quote on a simple BOP. Personal stuff they are not so bad, but the commercial side is a nightmare and i'm losing business because of it.

I know signed a contract, but if they are making it very difficult to do business, i have to find other ways. I don't have to properly answer you back Red Blooded, I'll get you later today. lol

Don't know why people are getting up in arms about this question, I think it's a legitimate one. Clusters serve a purpose but what do you do when you've outgrown the need for them?

In the loan industry there was something similar. If you didn't have several years of experience, it was hard to sign w/ banks, you would join a "cluster". Once you outgrew the need for the "cluster", you left and signed up directly w/ banks. There was a non-compete but it was no big deal. However there are couple of differences btw mtg and ins business. Mtg is one and done, you didn't have a BoB to take w/ you like you do in Ins. Also, there seems to be a lot more banks then ins co. plus you could write w/ banks such as Wells Fargo, BoA, Chase, etc. In ins, the "cluster" seems to have the market cornered w/ ins co you can write w/ and you don't have the option to write for Geico, Farmers, etc.

So what do you do when you outgrow the need for the cluster? W/o access to the competitive Insurance Co, how do you survive the next 2 years? Just doesn't seem right.

so are you not able to get direct contracts outside of the cluster? I can....

I can get appointments outside the cluster, as long as they are not appointed with the cluster. My problem is, they are appointed with every single carrier under the sun.

jack i feel your pain, it is the not the commission split you are mad over. but the red tape, just to get a simple bop. quote. and you are loosing business. i would talk to the others agents in the cluster, and see if they are also having problems, maybe if enough of you are having the same problem. as a group you maybe able to change it.. document all the problems, talk with an attorney, and as some say on this forum, join pre- paid legal. i would be proactive and file a motion with the court, to nulify your cluster agreement. that alone may get you out of the cluster, they may let you leave, so they don't have to go to court.. i take it it is not a siaa cluster, that is who red blooded is with...

JCK, whatever, but there are brokers out there who have the same carriers you do, for example, look up Commercial Insurance - Workers Comp - Workers Compensation Insurance, The Hartford, Travelers, Casualty, Online Quotes
Britt Paulk Programs

there are many brokers out there that will still have the same carriers. You might not get direct appts, but whatever.

Back to your orginal thread thou, you signed the contract you need to follow it, you must not have dont research before you signed, I did, and I dont regret my decision.
