Dave I didn't testify first of all.. Lou called me from the bank, and he had me talk to the manager as they were getting a hard time moving the money.I believe I was put on "hold" until manager came to the phone. It may of appeared to the bank manager I called her which is completely false.

This is directly from page 6 of your "Statement of Appealability" which was posted 2 pages ago.

A few minutes before Fran and Jochim's arrival at the bank on that date, Robinson received a call from appellant to the effect that if there were any delay in issuing the Allianz check, the bank would be reported to the district attorney's office. (2RT 268-269.)
 
Dave if you could post the section about the states expert witness. And see if others see the bia's in his testimony as I did. His lawyer put on a poor defense. He thought he had it in the bag. Like Peyton Manny did on sunday. I am not one to judge Glenn. All We could do is give him idea's. Glenn you should give the insurance investigator a call, he seem like a knowledge man. It is worth the time to call him. His information is on the ampm fourm. I would be interested in his take on your problem. Just my opinion.

Both 'expert' witnesses presented a bit of bias, the document was written to highlight the opposing experts bias and lessen their experts bias. I would expect nothing less.

I saw a life settlement contract recently that has a one pager to address competency...worded as follows:

I would be surprised if a doctor would voluntarily sign that statement. It would open themselves up to liability if something happens.

Its the same as using doctors records for underwriting purposes imo.

I have had requests from carriers before for doctors statements to clarify certain things in a clients medical history. Seems like the same thing to me..

Doctors testify in court and in depositions all the time as to a persons mental competency. Not any different in this situation. Plus they get to bill the client/HI for the visit to get evaluated for competency.
