I wonder if a doctor would balk at the request due to concerns about his own future liability and exposure.

Would a client be offended and refuse to obtain the document and go with an agent who isn't asking for it or would they appreciate the due care the agent is exhibiting?

If explained correctly (to ensure there are no future family conflicts), it shouldn't be an issue - especially if they don't pay for it.

A Physician Statement of Good Health is fairly standard for many different situations. Doctors do them on a regular basis.
Often times certain jobs require a certificate/statement of good health, such as nursing homes, child care facilities, hospitals, etc.
Lawyers are using them for estate planning on a more regular basis these days as well.


There are standard medically accepted tests to indicate if a person is of sound mind or not. The courts order doctors to perform these tests all the time for legal matters. A doctor is able to definitively determine this, document it, and it should hold up to any future scrutiny.

When you have a signed document from a reputible doctor stating that your client was of sound mind at the time of purchase, and the clients kids just have their anger, I think that the agent would be safe even in the great state of Cali.

And then the actual cheats who are stealing money will get in cahoots with the bad doctors, making it more difficult to prosecute actual crimes.
