Appointment with Company with a Not Guilty Crimal Charge

It is Transamerica. My credit is fine. it is just this one incident. I have never been asked to explain myself in the past, so it freaks me out a bit.

Also, it does show up as an accusation but the felony was thrown out. i ended up being charged with a misdemeanor for which i was found not guilty

I believe you will be fine then. They probably just wanted to know why the felony was thrown out and charged only a misdemeanor. If the company questions it being thrown out, then just provide them proof that it was thrown out....worse case scenario.

Most of the insurance companies want to know about serious charges like robberies to the full extent, arson, fraud, repeat felons, murders...big stuff like that.

Having spent 20 years in law enforcement, I can tell you that there are a couple of things most people don't know about their criminal background.

1) Many criminal background checks contain missing and incomplete information. Often times, the felony charge will appear but they will not record the disposition of the case. This is especially true when a law enforcement agency makes the charge, then the State (or District) Attorney files the child as something other than the initial arrest. It is seldom cleaned up where a lay person can understand what happened there. This might be why it requires an explanation.

2) If you were acquitted, "found not guilty", it is just the same as if nothing had ever happened. It cannot be held against you and you cannot be tried for that same accusation again. Many people think, though, they they were found not guilty when, in reality, they did a plea bargain with the prosecutor for a misdemeanor version of the charge. They plead "No Contest" to the lesser charge and the felony goes away. This is not the same thing as a "Not Guilty", and still could hold snares for you in the future.

If it was a Not Guilty as a result of a jury or non-jury trial, you're free and clear and should never have to worry about it again. As a matter of fact, in most all states you can have this expunged from your criminal record by the order of a judge. Contact a lawyer for the procedure, but it's fairly simple - a motion and an order.

I think I understand. I did not plea anything down. They "nolle Prosequie" the felony charge and charged me with a second degree misdemeanor assault for which I was found not guilty. So u think I will be ok? I think they saw felony nolle pros and just wanted further explanation. I think it might be standard procedure. Do u agree?

It is. If it's Florida, you can get a "No File" record from the prosecutor's office, proving that the case was done away with. The successful conclusion to the misdemeanor case would be something you'd want to keep in your records, too.
 
So, is she still your wife? Or was the broken finger the end of it? Just curious.... I guess I'm wondering if it was accidental or intentional, on her part.

Your kidding right...You actually need to do something to make your wife mad....There are times of the month when She yells at me for something I did in HER DREAM!!!
 
No. She is my ex wife now. We had agreed to separate -her idea by the way- and she told me I was not allowed in the bedroom. I slept on the couch while we tried to sell our house. One day I decided to sleep in the bed. I did however pay the mortgage and bought the bed. She decided I was out of line and punched me several times giving me a small black eye. She fractured her pinky in the process and charged me. I am actually am not sure if she broke it on my head or my hand as I was blocking her punches.I am a good guy and would never hurt a woman. in retrospect, I should have known better than to argue over the bed- knowing her temper. This was not the first time she hit me.

Okay, just because I feel some brotherhood bonding here, I'll tell my background check experience so you guys know that it's not just us ladies that can be unreasonable. Even though I worked for more than 20 years for the DoD with a secret clearance without any followup questions, the insurance background check turned up a charge for me of profanity in Virginia. The incident happened 30 years ago during my divorce and I pled guilty because yes, I did swear at the cheater. He called the police, his mother backed him up and I spent the night in jail. What a prince. My captive company wanted me to get a copy of the police record, the Norfolk PD laughed at me and said first they had never heard of anyone being charged with that and second they would not spend the man hours finding the record. Eventually, after much chuckling at my expense in the home office, they just accepted my word for it. After all, I was saying that I did it! :yes:
 
That is crazy! Well I thought my problems were behind me. I just don't want this stupid incident affecting my career. That would be ridiculous.
