You should get your deductible back from the other person's car insurance company. Even if you submitted the claim through your own company, your insurance carrier will subrogate the damages to get reimbursed from that other driver/company including your deductible amount and any rental car fees you incurred. If the other person doesn't have insurance, you can still try to collect (sue) to get your deductible back. Your car insurance company will also work towards getting reimbursed for the damages.
