Client's HR Won't Drop Them From Employer Plan

Hi, new client of mine. Her Med Supp plan started on 3/1 and she waited until after to get with HR to come off of her employer plan.

They are telling her she does not have a Qualifying Life Event (QLE)

Her T65 effective date was 1/1/2025 but she waited to get signed up. What can I do here to assist her?

As far as I know, she should be able to come off of her employer plan no problem.

I have run in to this before and it wasn't worth fighting he employer but I assume there is some government agency she could call to complain if said government agency is still open for business
Sucks for client if they already enrolled in part b but that can be postponed with some hoop jumping

Unfortunate lesson to learn. I always advise potential clients in this situation prior to enrolling in Part B to confirm with HR that they will be allowed to opt out of the group plan.

You can always opt out when you're turning 65 and activating Part B. But I've seen some employers refuse when the person delayed Part B. They've had to wait until the next enrollment period to dump the group plan.

I am sharing this for the benefit of other agents who are new and reading the comments.

Part B isn't delayed in this case. Employer triple AAA

Getting off the group plan depends on a lot of things. The employer does not have to let her term without a QLE. She can fight it but likely she will go until renewal with Medicare paying secondary and she'll have double cost for her healthcare.

When does her group plan renew?

Turning 65 and going onto Medicare is a QLE is it not?

More than likely, this is probably due to enrollment in a pre-tax plan, which has rules about terminating coverage off-anniversary without a qualifying event.
 
Turning 65 is but since she waited until March, she missed the window. If she would have gone to them in Jan she would have had no problem
……

But since you have that three month eligibility window, does that not allow you to drop it within that three months after your birthday?
