CMS Telephone Recording Requirement

UHC put out a guide that describes each situation and then acceptable actions, acceptable outcomes and future permission to call. It's 20 some odd pages of rules.

You got me interested in UHC again. So, I spent two hours searching around their DOS level web site.

I have a real problem with UHC. After my search I found two outbound telemarketing scripts for MA plans.:policeman: Here's one that I kept a copy of (M0011_060829J (10/06)).

What a messed up organization. I wouldn't put much faith in their guide. They still have the 2008 MA Agent Guide available. I can't believe AARP puts up with their crap. They don't have any of the AARP MA materials ready for order. Oh, except they did have the AARP application available.

I like their agent contracts, PDP's, MedSupps, and that's about it!

I'm not going to sell their stuff anymore either. I just got that email and guide from somewhere in all the re-certifications for '09. It was the only all inclusive thing I had seen from any company. Some of it directly contrary to what other companies are saying.

I want to service my clients and do in an ethical and legal manner. The problem is, I don't know who's rules to follow.

I intend to do what I feel is ethical and in the best interest of the client. That's what has always worked for me.The ones that call me, I will schedule an appointment and I will have then sign off on it. If changing their plan is right, I will change their plan. If this gets me afoul of CMS, then it just will. I'm certainly not intentionally violating rules.
 
Retread - I ran my idea past the powers that be and they suggested to do what you are referring to.

Leave the packets in your car. That way, you get the scope of appointment signed, ask what plan they are wanting to see so you can go get the packet.

So, I have a clip board now that I walk up to the door with, then I go to my car, switch the clip board for my bag, and then go to my appointment.

I would never advise any agent to do something to get them in hot water, but according to CMS, talking to seniors about anything will get you in hot water.

Thanks for the feedback on my strategy... it seemed like the most sensible way to handle the situation. Glad the "powers that be" are in agreement...:nah:
