Day 2 Of Argument...Not A Good Day For The Mandate

Mandate-schmandate. Obama's now out blathering the only 2% of all Americans would be affected by the mandate.

Striking down the mandate is one thing, but is cannot be severable. If the justices rule that the mandate has to go but also rule that it's severable from the rest of the legislation, it'll be all systems go.

They'd not only need to strike down the mandate, but also rule that it's not severable which mean all of PPACA goes bye bye.
 
And John are you predicting the entire thing goes or no?

The plaintiffs are making some good argument.
One angle is if the federal gov. can force you to buy a health policy then they will have unchecked power to mandate additional purchases.

We will see what happens.

If they rule the mandate is unconstitutional the entire law folds. There is no way that congress will approve funding for any aspect of it.

There are parts of the law that do not require funding. Remember the MLR? How about adults up to age 26 being covered on mommy and daddy's plan? No underwriting for kids?

It would seem that without the entire law being null and void, or it being repealed in full, agents are still screwed and prices will continue to rise.

The lasting effect of electing socialists will remain until we are completely bankrupt.

It could be the worst case scenario if it doesn't go forward for agents. As Rick state, nothing would unwind the MLR or if it was unwound, I can imagine it would be a complicated process.

So agents would be left averaging 10% commish without being able to write child-only, almost no policies include maternity and obviously underwritten.

For some reason I think some agents feel that if the justices shoot down the PPACA, it'll be like Dorthy waking back up in Kansas. No....it won't.
