6 months ago a family member was accidently killed by an auto while on his bicycle in Arizona. It was ruled an accident. We have been contacted by a lawyer that says the insurance company would like to honor the policy. It was a 25 thousand pilicy. He says that his son in California will get 8 + thousand. The mother in Arizona will get 8 + thousand. And he will get 8 thousand for handling the case. Does that sound right? Do I even need a lawyer? I don't understand why we need to pay a lawyer if the insurance company so willing to honor a claim.

Who contacted the lawyer to start with... Yes, they do usually get 1/3 of any settlement but you shouldn't need one for a life claim. The beneficiary just needs to send them a claim form and a death certificate. You only need a lawyer if the company does not pay.

I was wondering the same. How did a lawyer get involved to begin with?

I'm guessing this is the auto insurance company, not life insurance, correct?

You may want to run this case by your own lawyer to see what your options are. I wouldn't sign anything until you have counsel that's representing your family's interests.
 
If this is an auto accident settlement, most states allow a minor to wait until they are 18 to finalize a lawsuit. if that son is a minor, he has legal rights to his dads estate & thus a role to play in a decision on whether to sue the at fault party for more. without the details of knowing if the at fault party is a known person or hit & run. is the payment coming from the at fault parties insurers bodily injury coverage or is it coming from the deceaseds own auto policy (underinsured/uninsured coverage)

If this is just a life policy, I cant fathom why a lawyer would be involved unless there was no beneficiary & the lawyer is having to take it through probate. but, even then, this sounds extreme to me

If this is a wrongful death claim, you need your own attorney. There's a concept called Human Economic Life Value that would be the proper amount to sue for.

The attorney (I believe) is to make sure that you don't sue for more and close the case. Obviously on retainer to represent the insurance company.
