False Insurance Information

I was hit by a driver who ran a red light. I have two witnesses that say he was at fault. Both cars were towed to the auto pound. My vehicle is totaled. I went by ambulance to the ER. He told the police he had a green light so the police report says they are unable to determine who was at fault at this time. The driver's name on the police report is different from the owner of the vehicle that hit me. I contacted the insurance company on the police report and was told they have no policy with either the driver or the owner of the vehicle or the vehicle itself. The policy number on the police report is on another individual in another city and another vehicle. In addition, the address on the police report is owned by someone other than the driver or the owner of the vehicle. It seems obvious the driver who hit me gave false information to the police. Since his vehicle is a new 2013 SUV, I'm assuming there is most likely insurance on the vehicle, but it evidently is not with the company on the policy report. I have hired an attorney. Is there anything I can do to make sure this driver and his insurance company is held accountable for running the red light and the damage to my vehicle and my medical expenses? If my insurance company ends up paying the claim, can they raise my premiums or cancel my coverage if it is proven I was not at fault? Is there any way to determine who his coverage is with? Am I just stuck simply because he had the presence of mind to give false information to the police?

The state should be able to find out who the registered owner is. Go after that person is my guess. If it is determined they don't have insurance then you sue them. If they have nothing to sue for, then it might be difficult to be compensated. Do you have uninsured motorist liability coverage?

File the claim with your insurance company if you haven't done so already. This will get your car fixed/replaced/whatever.

It's unlikely that you will get past the red light 'who was at fault' issue in reality. If your insurance company can't track down the other driver, they will usually just assign them as at fault (not always), pay to get you taken care of (depending on your coverages) and move on. You will probably have to pay your deductible this way, at least up front, they may recover this for you though.

Don't put it past the police officer writing down the wrong policy number. It's a lot of digits to track on these things. It happens. Not often, but it happens. The insurance company / attorney have ways to help fix this.

The insurance company on the police report says they have no insurance coverage for a vehicle of that description or VIN. I know the VIN is correct because I checked on the TX DMV website. The police report shows the registered owner.

Is there any way to find out if a vehicle is insured if you have the VIN, make, model, year and owner of the vehicle? For example, is there any kind of a database that can be accessed? Or, can I just call insurance companies at random and, with that information, find out if they carry a policy on the vehicle? Any ideas?

He says ask a friend at the police department or check with the DMV. This information is not much help.

Seriously, you don't need to spend much time trying to track them down. Let your insurance company do it. As long as you had collision coverage, your insurance company knows how to track this down.

Your insurance will pay to cover your damage and go after the other driver for you. Don't lose sleep over it.

This is exactly what I would do in this situation.
