From all my research online and reading hundreds of posts, most criminal histories aren't relevant UNLESS is is a moral turpitude crime or a crime against a insurance company. Then again, I am in South Carolina and thats what our laws state.

I am in Ohio. Just finished serving a 20 month sentence in federal prison, for crimes committed in '98-2001 (it took years for them to allow me to plead guilty). I received my grand jury subpeona in '02, did not got go to prison till '08.

I would like to sell either final expense or mortgage protection life products.

My charges I pled to were:

1) Subscribing to a Tax Return which he did not believe to be true and Correct as to Every Material Matter

2) Making False Documents Containing Materially False Statements

Prior to '02 I was in real estate, and a top, top, top performer ( 5 years in a row, multiple 6 figure income). In '03 took a break, and started a drain cleaning business, which won the Angie's List Super Service Award 3 years in a row. Terrific comments from clients testifying to what a great job we did (I sold the business before entering prison). Why I bring this out, is I feel I rehabilitated myself even BEFORE I went to prison. I screwed up (BAD), and paid bad.

This is a 2 prong question.

First - does anyone know if the Dept of Insurance will grant me a waiver. I know they CAN, the question is will they? Can anyone recommend an atty in Columbus, Ohio that would be good at advocating this for me?

The second is the second hurdle? IF I get the license, and I get an agency to take me on, will any insurers allow me to write for them?

I KNOW this will not be easy. I just want to know if it is doable.
The funny thing is, due to my experience, I am likely the most honest person out there now. I have become nuts about honesty.

If anyone would like to consider taking me on, and advocating for me, I can promise you an amazing rep. We are talking someone who will work any area, 60 - 70 hours per week, invest time, money, etc. I am tremendous in sales.

I'd really appreciate some replies and input. God Bless you all. Please give me some suggestions if you can. I am looking for more then the actual Ohio Revised Code (which I read). I am looking for people who have experience with these situations.

First and foremost, be honest. I know you said your straight up now but I think by disclosing the conviction they will still consider you. When you apply for your appointment, make sure you get certified copies of the criminal charges as well as whatever the disposition was.

I have zero desire not to disclose it, or to try to get around it. Just the opposite. I don't want to build a career, and then worry someone would find out about my past. Open, and honest is how I want to handle this, not like a snake slinking around in the night.

1.) Try to get an attorney to go to court and get an "Expungement" of the convictions.

2.) Petition for a Pardon with the Board of Pardons.

3.) Apply for a "Restoration of Civil and Political Rights"

Or wait for 5 years after the end of your sentence.
 
It looks like he did not get his license. For anyone else who may have a question on getting your license, with a criminal record. Just call your DOI, and ask them. they will be the best ones to answer the questions. Just don't lie to them.
 
I would NOT be willing to give someone a license, an appointment with a carrier or placed as a subagent in my agency. A felony involving falsified documents is exactly why he should not be in insurance industry. There are other ways to make money besides being an insurance agent.
