I'm not playing devils advocate here regarding this topic, but I came across some data that I thought would have value in this discussion.
It seems that the noted carrier had only 3 Gold plan types O ON E and 0 OFF E for the entire state last year. Further 0 ON E and 0 OFF E for Platinum plans.

Now this being said, clearly the law doesn't require any carrier to offer all 5 types of plans otherwise all of the carriers would be offering all 5.
In light of this it should be noted that Several carriers didn't offer Platinum plans ON Exchange.
