Group Insurance in TX

the list bill thing is not illegal and not a no-no. what is illegal is the boss paying 100% for 3 guys to have insurance and not paying for another guy or more. if the boss collects the premium from all the guys, then mails it in on the list bill, and does not contribute, it is not illegal at all. the grey area becomes: is he really collecting cash from the guys.
 
Some carriers, in some states, on some industries (how's that for qualifying?) WILL write all 1099 groups.

Real estate agents come to mind.
 
Assurant will take 1099 groups
The rates are way high so its an impossible sale but it can be done.

Yes but is opening the employer and yourself for a lawsuit if the employee thinks it is a group plan.....most health plans have discontinued the list bill for this fact.....that is why it is always better for the employee to set the plan up on his account and employer to set up a performance bonus each month.....that way it can still be a write off for the employer....

Agreed. List bill opens you up for a lawsuit. Employees will get confused and think they had group, and then it turns into, "The agent told us this was a group plan"...

Sti, I've notice that the individual has to sign on the GR application stating that the employer is not directly or indirectly paying any portion of the premium if the empoyer has 2-50 employees. Would a "performance bonus" be an indirect payment for medical insurance?

I'll rephrase... could suggesting a "performance bonus" as the solution put you in jeopardy?

Its America.....you can pay your employees any way you want...I have ran up on many case's that tell me their employer is giving them x amount of dollars to get their own health insurance......
