How do you California agents answer this on applications since it's legalized by the state but considered illegal by the feds? Do you then list it on the drug list and give reason why prescribed ? What do you give as reason for use? Glaucoma? Nausea? Applicant burns fatties to relax ?

I'm not a California agent, but I've asked this question to underwriters before.

Most life insurance companies do not deny a policy based on Marijuana use alone. If someone is a casual pot smoker but doesn't do any harder drugs then usually they'll still qualify for the policy. They could possibly be table rated if there is any medical issue connected to the use or if the person is considered a 'chronic' pot smoker instead of a casual one.

If they are just a casual smoker and no other issues, then usually they will qualify for a tobacco rate (even if they don't smoke tobacco).
