They should be able to get something without using an attorney. Here, if someone starts running into road blocks with the at-faults insurance. We tell them to file a claim through us and then we subrogate. I've been told by other agents if one of ours has a run in with Geico or Safeauto, to just file through our company due to geico and sa fighting insureds tooth and nail.
 
In Florida, most carrier offer extended PIP that extends beyond the statute requirements. For instance, The Hartford offers offers up to 100k PIP coverage. Health insurance kicks in after PIP has exhausted.

Actually, out of the 16 auto carriers I represent, they have gotten away from offering Additional PIP and Extended PIP. (Extended PIP increases the medical to 100% instead of 80% and loss wages to 80% instead of 60%. Additional PIP brings it up to 50K or 100k, etc.) I have a customer I am working with right now and they want add. pip. Allied and The Hartford are the only two I have (I didn't actually check them all just yet so I am just going off memory) that will offer it. Nationwide offers it at 50k and The Hartford at 100k. A few offer extended PIP. They are expensive to add and in my opinion not really worth it.
