The TCPA was explicit. If you want to send someone a text, they need to specifically give you permission for a text. How is this being litigated? Who knows. A single text message when someone filled out a card may not be "that bad", but in terms of at least knowing what the rules are, that's prohibited. They would need another box that says you can text them (or something like that).
 
I would think a voice recording asking for consent for an agent to talk with them would be pretty iron clad?

I don't think I have EVER consented to an auto warranty company to contact me at all, but I seem to get those calls almost daily!
 
It's funny . I get 10-15 unsolicited calls a day still . A few get in trouble but 99.9% never do

EFES had to pay out a 1-million dollar fine for texting someone a year or two ago. I don't know the details of that but it's a real concern that any marketer needs to be aware of. Especially as more and more agents use automation.

You have already violated the DNC when they were called to ask permission to call.

Seriously - think about maybe it's time to migrate your telesales marketing to "prospect initiated" inbound calls...versus some funky Azerbaijan call center doing transfers...(or for DM make sure the return card has permission for you to call them verbiage included)

We're getting inbound calls initiated by the prospects themselves. BUT - they may need to get a call back or a text for whatever reason (maybe only 20-25% will be a one call close)...

For that reason and to stay safe from TCPA issues - I've included this comment in my script very early on in the conversation (of course all calls are being recorded for quality control and training purposes LOL):
