Said They Were Married and They Are Not, Suggestions?

Client on-x last year, went on as "married" they are well known so they divorced for financial gain several years ago and kept the name. So, on-x, when she brought in income docs she had two, filing single, WTF, says me, she leans in and whispers, "we're not married".

Any way to help her fix this mess for 2015 or does she just loose 100% of the tax credit or is it reset to what it would have been if she went in honestly.
 
Personally, this is one of those cases I'd tell them that they are on their own.

They lied and your info is tied to it now. Wash your hands of the situation.

Show her on HC.gov and tell her there is nothing you can do now that it's after the fact and you were not truthful with me.
 
She lied. She loses the tax credit. I'd let her try to remedy it on her own - I agree with TKruger - I wouldn't have any more involvement with them on this particular issue. You don't want to be associated with someone who takes federal money under false pretenses. . . . .
 
Let them fix this themselves. For as little as you make from health sales, to put your license on the line is well... silly.

They lied to you, and if they lied to you, they will be more than willing to tell the government you told them to do this and basically make your life hell. Run away.
 
Additionally, to cover your a$$ call her on a recorded line and advise her of the fact that since she misrepresented being married you won't be able to assist her further.

At the same time if you have enrolled her into a 2016 plan advise her that you must make the changes on the current application. If she balks advise her that you are canceling her 2016 plan and application due to her attempts at defrauding the federal government and that she needs to call HC.gov to re-enroll.
