must be a married couple - one who owns the business needs to have their spouse on payroll as an employee -which means workers comp and the whole nine. I believe the spouse also needs to work a certain amount of hours per week - forgot how many.

The spouse has the health insurance and gets to deduct the premiums off federal and state taxes - however you can only deduct a portion of the premium bases on the spouse's pay.
