Jan 2014 Agent 1 enrolled 63 yr old male, spouse 64 premium under $400 per month.
Oct 2014 spouse turned 65 came into office with spouse to cancel her off plan.
Since there are two different ways to take spouse off depending on whether or not they received a subsidy Agent 2 (agent 1 gone) asked if they received a subsidy and they said no, Agent 2 said are you sure and they said yes that Agent 1 said they did not get one. Agent 2 take's has spouse fill out form to send to insurance company, insurance company says they receive a subsidy and have to call marketplace. They took her off and his next premium was $500 per month (went up) Called agent 2 and said I want to cancel Agent 2 said call marketplace so he did and everything cancelled. Then client come's into office wanting Agent 2 to rewrite a plan, Agent 2 did some questioning and found out client could have gone on group beginning of 2014 and it was very affordable, agent 2 backed away and said you are better off going on group Jan 1, 2015, then Agent 2 went to boss and said expect some law suits after tax season.
Agent 2 being the loyal lapdog he is did not mention to the client to expect a clawback, but Agent 2 is praying Agent 1 will lose his license.
BTW Agent 2 has run into a slew of people in the past couple of months that are going to get clawbacked and some agent's losing their license's.
Now if we only knew who Agent #2 was it would all make more sense.

So lets walk through this....If they self enroll they can't blame anyone right?
If they use a navigator they can blame the navi and the navi might get written up and a letter put their file..right? If they use an agent they can blame the agent the agent loses his license, all renewals if applicable and his E&O gets sued...right? I think I got it now....man o man I'm glad I office with a Lawyer and my Sis is one too....sheeesh
