Statute of Limitations on Filing a Hail Claim.

I was traveling in Dallas on June 13, 2012 and a large hail storm rained down on my brand new truck. It damaged the hood and driver side panels. This was softball sized hail so it created a large amount of damage. My policy with progressive ended on June 21 and a new one came into affect. I'm a struggling student and was already struggling with juggling the new payments of the truck and insurance. I've saved up the $500 to get this fixed and am ready to file a claim.

However, before I did I was worried if the fact the policy ran out and a new one started would affect anything. There was another hail storm two weeks after while I was still in Texas but I was under a garaged roof. While I would rather be truthful about when it happened I do pay insurance ($225 a month for a mid twenties male with no accidents/tickets, which seems really high) and want it fixed.

You need to file this TODAY.
Was there a lapse between the 2 policies? If not, then it doesn't matter at all, if the policies were with the same carrier. Nobody will bat an eyelash at that fact.

The 6 month delay in filing the claim will start to be a problem. You need to file this and get the process started.

What matters is the insurance that you had at the time of the loss.

There isn't a statute of limitations, but your policy generally has a "reasonable period of time" to give them notice. Six months is a long time, usually 30 days is even excessive. The adjuster is going to wonder why you waited so long.

Will the allow them to deny the claim? I got a general estimate from a Paint less dent removal tech who was getting gas beside me. He said it should be close to five thousand. I just want to come up with a strategy before I file this claim.

You should have reported it immediately. If you haven't reported it yet, I would report it now. Yes, it is grounds for them to deny a claim. That doesn't mean they'll automatically deny it, but unless you have something to hide (which you shouldn't), there is no reason to wait to file a claim.

So in case this hasn't been clear, file the claim now. Like grab your phone right now and call progressive to file a claim. You shouldn't be reading this sentence unless the phone is already ringing while you're calling progressive.

With no lapses, it really doesn't matter, but, to protect yourself, you need to get the claim filed.

Doesn't matter if you don't have your deductible to fix it, it can be fixed later, but the claim needs to be filed.

As long as you don't have a lapse in coverage you will be fine. Go ahead and make that claim because it will be covered. If your policy was in a lapse then it depends on the statute limitations. For example, in NY, when you are in a lapse of coverage (haven't made payment last 10days) you are still covered for those 10 days after your policy hasn't been paid. You want to check with your state's statute of limitations on lapse if you were in a lapse of coverage. If your not, then you will be fine. Hope that helps.
 
In Texas you have technically 2 years and 1 day to file a claim. It does not matter if it was on the old term either. But just like the other posts, you really should have filed the claim when it happened but I understand you had money issues. The only problem is that the carrier may deny it because they do not have the proof that all the damage was from back in June unless you took them with dates.

However, even though there was a recent hail storm, do not lie about the date of the claim because that will constitute insurance fraud and your claim would definitely be denied than if it came back.

Just file it now and be honest. Thanks!
