Subsidy Tax Refund Flaw

My new favorite term is "financial colonoscopy".

I can see it now: "I lost my job 10 months after talking to you, I would have qualified for a subsidy if you put me in the HIX." LAWSUIT.

Keep in mind, it's based off of ESTIMATED MAGI, which will include many of the deductions you mentioned. After you take your guess and send the client somewhere, just hope that misreading their financial crystal ball doesn't result in a suit.

This is all conjecture until filed & approved rates and plan descriptions are available for products inside and out of the exchange. Who knows, maybe "private exchanges" will have less doctors in network. Maybe the HIX won't ever open. Maybe clients will take responsibility for their misinformation and bad decisions.

I want to know what your smoking and can I get some....Clients taking responsibility for thier misinformation lol.

I wonder if you provided a form where the customer filled in info such as income etc and they signed said form and then you provided a recommendation that in writing stated said recommendation is based on the info provided on this form provided by the client and changes can affect your actual subsidy amount.

a cya disclaimer is a thought but answer this question. With MAPD plans can you present ANYTHING that has not been approved by CMS? Next, since CMS is heading the show here what are the chances having anything stamped as CMS approved other than what they give us would be held up as legitimate form document in a court of law?
