If the entire enchilada is stuck down I really don't know what that means. Would it mean the national risk pool closes? Would it immediately void the MLR rule?

I have a feeling Congress would pass some kind of emergency legislation to at least keep the risk pool running.

And that would be the smartest decision they have made in 4 years. I have always advocated for a national risk pool with very defined entry requirements.

apply a subsidy tax to the insurance companies based on precentage of business written to offset the losses.

example: if Humana writes 6% of overall national business on indy health they are required to kick in 6% of the insurance company subsidy... My plan is more complex than that but you get the idea.

FL tried something similar on their risk pool. As I recall, it was open to new entrants for maybe 2 years. I believe it has been closed at least 15 years.

That being said, I do like PCIP even if we don't get paid on it.
 
PCIP definitely has its place, as does any state risk pool. It's too bad the general public didn't understand its value as well as insurance agents understand it. The low enrollment is partly due to lack of knowledge. It seems that any economy should have a safety net for its uninsurable population.
