Thinking of Starting My Own Insurance Agency

Not totally.

While working for a large insurance company in management (in FL), I testified in two of these cases that actually went to trial.

What happened in both cases was that the judge didn't stop someone from working in the insurance business, but the producer was not allowed to solicit any previous policyholders until the expiration of the non-compete.

Very True.

I think we are talking about something a little bit different.

I might not have read the thread correctly (which is possible...lol), but I was referring to simply a non compete clause that tries to keep a 1099 from working in a field , where they compete with their prior employer.

I definitely wasn't trying to convey that an agent could steal clients and get away without any consequences for their actions.

I have seen non competes end people's career in hi-tech sales here in MA.
After paying for a lawyer, the judge said" you signed this, you'll live by it for 4 years"

I appreciate all your responses regarding the non-compete...does anyone know of any company that offers E&O with someone that has less than 3 yrs experience in P&C but over 9 years in Health & Life.

Can I be ok if I answered yes to over 3 years since I currently work for a company that offers P&C and Health & Life for over 10 years?

Call the E&O company and ask them what their take is on it. I answered yes on one of the questions and my policy just took a little longer in u/w.
