While working for a large insurance company in management (in FL), I testified in two of these cases that actually went to trial.
What happened in both cases was that the judge didn't stop someone from working in the insurance business, but the producer was not allowed to solicit any previous policyholders until the expiration of the non-compete.

I think we are talking about something a little bit different.
I might not have read the thread correctly (which is possible...lol), but I was referring to simply a non compete clause that tries to keep a 1099 from working in a field , where they compete with their prior employer.
I definitely wasn't trying to convey that an agent could steal clients and get away without any consequences for their actions.
