Warning About State Farm Insurance

I was rear-ended in my car by an ex-convict. This took place on a medium sized road in Tucker Georgia. At that time, my insurer was State Farm. They took my statement and the statement of the ex-con, did no other research, and found me liable for the accident. I finally had my day in court in DeKalb County Georgia. I won. My case was dismissed because the ex-con never showed up.

Be warned, I've never had this problem before and I'm certain that State Farm simply found it cheaper to do no research on the accident other than making 2 phone calls.
 
Without posting the actual facts of the accident, it may have been your fault. It doesn't matter though. You could have still filed a claim with his insurance company. If you were denied or he didn't have coverage, then your claim with State Farm would be against your collision coverage. Then fault doesn't matter. You are responsible for your own deductible either way. It's neither cheaper nor more expensive for State Farm up front. Cheaper would have been them finding the other guy at fault so they can subrogate and get their money back.

When someone is rearended, it's almost always the person in the rear's fault. So if State Farm determined it was your fault, the facts of loss were probably pretty clear.
 
Not a big fan of snake farm either. But I don't blame them in your case. You filed the claim with the wrong company.

Why do you say that?
Its frequently easier to file with your own insurance company than to bother with the other one. Yeah, you have to pay your deductible upfront, but you should get that back.

I have a lot of clients that file with their insurance company on accidents. It is their choice.

Good thing you don't have any in NY. Folks get jammed up with that there and it can impact rates.
 
Don't send your New York methods to CA then!!!!
The biggest advantage to filing with your own company is simply the fix happens faster, usually at least 2 days faster, sometimes 30 days.

Fault determination doesn't have to be done before repairs are completed.

maybe CA is different. But I've been amazed at how much a not at fault accident can raise rates with some carriers. It doesn't rate as bad as an at fault, but it's can still be a significant chunk.

So when one of my clients gets into an accident where the other party is at fault, I always recommend going after the other guy's insurance company first, and only get your own ins. co. involved if you get the runaround from the other guy's ins. company.
