My motorcycle accident and recovery might adds some clarity. the person who hit me had 25/50, state minimum coverage.....my UnderInsured coverage was 100/300. the first 25 was paid by his carrier and the left over 75 was paid by mine because he was UnderInsured. In this case the At Fault had 100 in liability and the aggrieved party has 25. I do not believe that he has a case for Underinsured because the At Fault has paid policy limits and his own coverage is less than the At Fault party. The settlement offer he receives from the At Fault will have a clause against additional lawsuits against the At Fault party. Taking a chance against accepting the settlement and winning a larger payout in a lawsuit can be foolish is the At Fault party has no real assets.
