It is funny how many clients think an audit will go away by ignoring it. Some companies hiring truckers/contractors here in NJ are now requiring the sole props, LLC members, etc to be included on the workers comp policy and to provide evidence of same. It seems that most states are really trying to close up all the loop holes that were out there are far as not paying for workers comp goes. They instituted a law in 2008 for automatic spousal inclusion for those companies owned by one spouse with the other working for it. The union guys that have their wives open up shop in their names are getting smacked in the face with their audits when this comes up. Typically, providing the payroll tax forms will satisfy the company, but some are now making the non-compensated employees submit their W-2 forms as well as evidence of pay from an outside entity. Maybe having your insured submit his company's yearly tax documents will help get what you need done?
