They certainly should be.

NY will allow licensed brokers (who receive no compensation from carriers....) to be Navigators/IPA's, but a license is not a prerequisite. Looks like an "exchange license" or certificate of completion for the exchange crash course is all that will be required. I'm sure union reps, Indian tribes, chamber of commerce employees, and the like will give excellent "guidance".
 
Even better, I'm sure that "agents" will be the ones singled out in news reports for having screwed someone over, whether or not they were a navigator or an agent.
 
There is a bill moving through the GA legislature that will require navigators to be licensed.

Hopefully, there will be an add-on to the bill requiring that the Navigator entities have maximum commercial Errors and Omissions insurance as well.

No no no, that makes too much sense. They are only providing "guidance" and "assistance", maybe even explaining something. They can't be held liable.

I imagine the whole PPACA certification course is just a gentleman standing at a board going "READ THE PAPER WE PROVIDED. DO NOT GIVE ADVICE OR OPINION." for a few hours before handing over a certificate.
