While I don't like the product, I hardly feel a conviction and prison time would be appropriate way to treat an agent in this situation.

I think it sets a bad precedent for agents.

I don't agree with the sale and I think Glen made a bad decision. However, none of it rises to the level of being criminal. That's insane.

financial elder abuse must also include proving either theft or fraud.

CA DOI commissioner has made it very clear that he will go after anyone he feels is taking advantage of seniors. I've followed another case out there, but it was very blatantly illegal what that agent was doing.

This case, not so much. I'm a former RN, before I got into the insurance field, and there are times you can't make the distinction on a client's mental status right away. If you talk with them during periods where there is more clarity, it's hard to tell. The old "sundown syndrome" where more confusion sets in later in the day may not be apparent if you meet with a client at 10 am!

Delimma?? I spoke to an attorney friend of mine today who has reviewed the initial brief.He feels it's "crap", and he feels were going to lose 0-3.He think's it holds "no weight". That it's very sloppy, and that the appelate judges wont give it it's due.
He said we need to do whatever we can do to get at a minimum Mark Geragos on board. He said his 100% first choice is Dennis Riordan. He's say's we will "walk" with Dennis representing us.Dennis has said this too. He also feel's Mark Geragos will be heard if we hire him, and we will also win.He said he doesn't think we have a prayer working with our current lawyer.
Dennis is 50K. Mark will take 15K down, and he could also be 50K?Help me I need your feedback.My attorney friend feels with the right counsel we win. I get my license, and my life back.Without the right counsel we lose, and it follows me around forever.It follows the insurance industry forever.
