The Ca. Supreme court has declined to review my case.I just found out yesterday.

Finally! This is behind you. It's a shame you were put in this position but I'm sure you started from scratch before and you'll be on top again.

Thats great to hear Glenn! At least the people at the top have a bit of common sense!


If I were you I would move the hell out of CA. Then pursue charges against that crazy DA that has this vendetta against you... (civil charges maybe? state bar ethics commission?)


Part of me thinks you should just let it be and move on. But another part feels that you should try to set a different precedent against overreaching politically aspiring hack DAs...

I hope all of those people who tried and convicted you in the court of public opinion including posters on this forum are ashamed. This was a situation where I did not understand why all agents and all insurance companies didn't rally to your defense.
 
The investigation determined that the victim lacked the mental capacity to enter into this contract, and that the terms and conditions of the annuity contract were not in her best financial interest.

SO it was sold illegally according to the Florida State laws and he got caught. Here if the person is intoxicated or does not have the mental capacity to understand the product it is not a legal contract. With that said a hefty fine and possible licensee revocation should have been sufficient. But it sure is a great example for other agents to not to play with the elderly. For those that say "there has to be more to this case". Not really. This is enough or are most agents that corrupt.

I dont think many agents agreed with what happened.
What many agents questioned, was the Suitability of the product sold.

But even if the Annuity was Unsuitable, it was not by any means an act of theft.

There was not one shred of hard evidence that the client had dementia at the time of sale. Even if she did, there was not one shred of evidence to prove that Glenn was aware of this fact.

First this is a California case. Second the trial happened years after the sale. Third are you an insurance agent if you are please tell me the medical training you have recieved to diagnose alzhemiers.

The facts are that the client met with this agent with her boyfriend present and an employ of said agent. None of the individuals part of the meeting INCLUDING the owner of the annuity ever claimed that she showed signs of mental illness during the meetings. Second the woman was not under any guardianship or conservatory agreement. Third the bank that actually alerted the authorities had no measures in place to stop the woman from accessing her money and the bank reps conversation with Glenn stated her concern with the influence the boyfriend had over the woman kind of like the influence I have over my wife inregards to financial decisions.

My grandmother had alzhemiers if I visited her in the morning she knew who I was and we could carry on a normal conversation about things in the recent and long ago past. Now if I visited her in the afternoon/evening and only made the mistake once she had no clue who I was and had the nurses come as she was afraid of me.
 
I think I learned a valuable lesson. There are two sides to each story. I should know this by know though. I wish I could take back my statement but it has already been quoted, lol. I am sorry if I offended anyone.

No problem some of us have been following this for years. The California law is pretty dangerous how any transaction like buying a house or an annuity could be turned into a criminal action just based on age of the consumer.
