Everyone seems to be forgetting which attorney asked for the claim to be made, the defendant's attorney. He probably wants to use it to show the plaintiff's attorney that there is no easy money here and hope it goes away.
If the insurance company felt there was a potential claim, wouldn't they want their own representation which means the defendant's attorney might be out of a job?
