Contestable claim for murder victim

One of my clients has a policy on her son that includes a rider for his children. Unfortunately, her teenage grandson was killed in a drive by shooting a few months ago. We sent in claim paperwork shortly after, but I'm being told by the company that the claim is held up because the county medical examiner won't release records due to "ongoing investigation".

I've had murder victims before, but only one that I can remember during contestability. In that case, the company (different co.) paid the face amount once they were satisfied with the health info they got back, but withheld the ADB portion until they got final disposition of the case from the police. I've also had a couple of cases that were not contestable and paid the base, but not the accident benefits because there was suspicion that the insured was engaged in illegal activity at the time of death (e.g., drug deal gone bad leading to a shootout.) But I've never had a case like this where even the base amount is being held until the police are through with the investigation. But then, I've also never had a contestable claim on a child rider, or a murder victim on a child rider. Does it make a difference that he was insured under a rider?

My client is getting frustrated, which is normal, but I'm starting to get frustrated, too! Anybody have any experience or insight about how to move this along?

Happened to me last year Shonceman. The original death cert listed cause of death "under investigation". He was shot in the street is what it was. I had the same frustration as you. I even asked for the name of the investigator and called. He did speak with me but said he could not commit on the case. I then met with the beni who was the grandmother, and tried to calm her fears a bit.

When you pride yourself on getting things done for your clients, this can be very frustrating. Hang in there and keep in touch with your client. :)
 
Interesting thread here gentlemen - can anyone comment on whether or not a death certificate is required by most FE carriers? Will an obit or call from the funeral home suffice?

Depends on the company. I have at least one company that has paid on notification of death from the FH. Has cut the check within 24 hours of death.

Seems like I heard LH pays a percent that way as well.

Non accident and non contestible.
