I completely agree with your point, but running an "illegal" website on servers in another country with less regulations isn't probably the best example because is common and acceptable practice. There are a number of online gambling sites which wouldn't be able to operate if they were hosted here, but are on offshore servers and the courts have ruled that there is basically nothing they can do about. The important thing to keep in mind about any marketing method is that as an insurance agent, you're almost as responsible for what the marketing companies do on your behalf as you would be for any employees you would hire.

The other thing worth mentioning is that in your example, I strongly doubt that "Maryland Health Plans" would be subject to the fine or being sued, unless it was a captive agent acting under the direction of the powers that be within Maryland Health Plans. So if the sales VP told the agents to hire a company to provide autodialer leads, then the plan would be responsible for any consequences of doing so. If an indy agent is doing their own marketing and uses a carrier name while using illegal marketing methods, it's more likely that the carrier will pull out a copy of a signed agreement where the agent said they wouldn't do things like that, forward a copy to the courts and say "Sorry about that, he/she signed this contract stating that they would abide by all state and federal marketing guidelines while marketing our products. After conducting our own investigation we feel that the agent is in breach of their contract and we have terminated their appointment." and that'd probably be the end of that. Health insurance companies usually employ talented and highly paid attorneys that help them avoid liabilities like that.
 
I've always been interested in doing the church circuit. If you can get some info from your friend, I'd like to know some info about how he/she got started doing that, and lessons learned. Things like what is the ideal size of a church, what are some of the things to say and not say when talking to a pastor about doing a presentation, what type of churches, if any, get better results.

This, to me, is a great way to get leads that would benefit the church and the church members.
I still remember agents doing those back in the late 1970's. Amazing how these ideas come back after a generation.
