They do get sued. However, it can be hard for the employer to prove that the producer was directly marketing the book. For the captives the company is usually so big that they don't want to waste their time unless the person was a big time producer with a lot of business on the books.

Non compete's are not enforceable in CA. You can protect your trade secrets and work product (client list, account info, etc) but if a producer leaves without taking that info (in a way you can prove) and one of his old clients want to follow him... there is not much you can do to stop it. You can make it hard on him but you cannot stop him. It is best to just play fair and give them an option to buy out the book if they want it.
