True but don't all states have a "continuation..." such as Texas (6 months), isn't this a nationwide thing - or is this just a Texas thing?

It varies by state and not all states have mini-COBRA programs. I think abotu 40 do at this time. There are some strange rules out there as well. Ohio says 10-19 below 10 nothing. In Nevada, you can't get mini-COBRA if you voluntarily leave your job. California is 36 months state continuation.

All groups of 20+ employees that have group coverage, and you are part of that group, must offer COBRA continuation. Each state has their own rules governing plans for 19 or fewer employees.

Some plans are exempt from COBRA including government employees and some church related organizations. Employers may offer mini-meds which are exempt, or individual policy's on PRD. These are also exempt from COBRA.

All states are required to have HIPAA continuation provisions in place regardless of the number of employees covered under the group plan.

Yes, 20+ for at least one half of the previous calendar year. Some groups can flux in and out depending on employee population. Also, fractional counting for PT employees is required. For example, 15 full-timers plus 8 part-timers may or may not fall under federal COBRA, depends on how many hours the part-timers are working.

Yup, however FEHB does offer federal employees continuation similar to COBRA, but with a twist. The amount of continuation you get on FEHB is determined by a formula of the time you worked for the federal government. Sometimes 18 months, sometimes more, sometimes less.

Yes, covered under the 1996 HIPAA law. Each state is free to implement HIPAA coverage as it sees fit. Some states, like Illinois, run it through the CHIP program and there can be a waiting list to get into HIPAA coverage. Other states like CA require all carriers selling IFP in the state to provide coverage with no enrollment limits.
