The Wall Street Journal: Federal Judge Set To Rule On Health Law's Constitutionality
A Virginia federal judge is expected to rule Monday on whether the Obama administration's health law violates the Constitution, opening a new stage in the administration's defense of its biggest legislative achievement (Adamy and Perez, 12/13).
 
Remember, the Constitution was written with fairly flexible language, particularly the original document and older amendments. The Supreme Court has always been able to interpret it to fit the current cultural and political situation.
 
Just crossed the wires. Judge in VA finds the "mandate" portion unconstitutional. Next stop....supreme court. The rest of the law is constitutional. 100 to 1? You should have taken the bet....

Bet isn't collectible until the Supreme Court decides, as it will go there, and they are almost certain to hear the case. But first they have to hit the court of appeals for the district, unless the Supreme Court pulls it up to their level first. Since the mandate doesn't take effect until 2014, no reason for them to expedite matters.
 
Wait, but didn't they leave out the severability clause of this bill? In other words, if one portion is illegal, it's all illegal and can't be changed bit by bit?

Don't worry, the Supreme Court will save the law IF they do decide the mandate is illegal.
 
I'm no lawyer but It is common knowledge the whole HCR hinges upon the individual mandate. If they lose that it is game over.

The central issue in Virginia's lawsuit was whether the federal government has the power under the constitution to impose the insurance requirement. The Justice Department said the mandate is a proper exercise of the government's authority under the Commerce Clause.

Cuccinelli argued that while the government can regulate economic activity that substantially affects interstate commerce, the decision not to buy insurance amounts to economic inactivity that is beyond the government's reach.

I wish I could be optimistic. Social Security, Medicare, War on Drugs, War on Poverty, Forced unionization, etc. are all unconstitutional - until the supreme court re-writes the document.

Separate but equal was also Constitutional until the Supreme Court decided otherwise.

You cannot Not have health insurance?? I don't know what that is.
