Questions About a Non-compete Clause...

A non compete usually cannot hold up in court, they cannot prevent you from earning a living in your field.

And you should absolutely not consider the advice of taking your clients but not telling anyone, that's totally unethical which is exactly why safeguards like non competes are in place. If you sell new biz, you probably won't get bothered, a non compete clause's intent is to scare you, and it's obviously working.

Think about it, why would they pursue legal action (and waste money) if you aren't harming their business?

I dont think anyone told her to steal business, for one there's NONE to steal, except for a policy that was written for her, I doubt she will tell and there is no reason for her to over pay now that she is no longer in the dark.

Maybe I'm wrong but you seemed to imply that she could "replace" the business with clients she procured while working for her former company, that which she may have placed, justifying it by mentioning that people cancel all the time.

PS: You mentioned this advice before knowing if there was any business to steal. But I guess you know what your true intent was.

yep, he wrote me and fil/mil's policies. like i said, either in this post or one of my first... i thought all of this was normal. I thought this was how everyone started, you know your upline writing your policies until your licensed, and only making 25% and such.

Your policy is not in force. Non take it.
