Rules & Regulations Concerning Flier Distribution

I was wondering what types of rules and regulations concern Independent Insurance Brokers whom are appointed with several carriers, specifically if their target clients are Senior Citizens, and the product is Medicare Advantage Plans.

My question relates to the design of the fliers themselves that would target seniors (like they'll be left at their club houses) towards selling rather than providing information about the plan itself.

What is the limit that one may try without getting into trouble?

You would still need CMS Approval on any Advertising for Med Advantage.The carriers you represent would also want to approve any med advantage advertising. You are dealing with a highly regulated Market.
 
You can do generic flyers and mailers. Just don't mention specific benefits or companies.

As far as staying away from MA plans, I'm amazed that agents can state that they won't sell them. If they moved to CA, they'd change their tune.

I'll continue to help people (mainly duals) with MA plans. For those who lose their MA benefits after 2011, I'll be very happy to help them with Med Supps at that time.

If you are really in Alhambra, be sure you find a way to differentiate your offer from the other 50 plans available.
