They are saying current comp is already over the legal limits, when you include soft comp... which they consider to be included in the regulatory limits.
Also, the plaintiff outright lied about soft comp in their lawsuit. Not a great sign when you have to lie to get the outcome you want. And its a very clear lie that was easily rebutted in the link Sam provided.
Plaintiff had 1 single small focus group study to back up their argument.
HHS has 4 evidence backed studies using a large set of data. Even analyzed call recordings of agents in multiple studies.
Im a betting man, and I certainly would not bet on that lawsuit succeeding.

also would be interesting to know if Musk is having to pay the US government an affiliate fee for each link from DOGE.gov to X platform because those clicks are valuable to a website owner.
