Unfortunately being required to have insurance and people actually having insurance ain't the same thing.

Why do some people think they don't have to have car insurance?? The rest of us pay for the ones who don't. I don't know about you, but my rates are high enough. :goofy:

Most states do. I'm pretty sure CA does. Right, Rick?

Correct. We have to prove it every few years when we register our cars.

In addition, I discovered that when a speeding ticket is written for only being 12 over the limit, I (I mean the perp) must prove insurance and the policy information is entered on my (I mean the person's) ticket.

Some of the same people also drive without a license as well. I know someone doing that right now and he has been that way for a year.
 
Haha, thank you all very much for the replies. I agree, a different a replacement gf would be the proper financial decision. I was pretty upset when I found out that she didn't have insurance. I know she put herself in the situation. I was hoping to find some sort of loophole. She was cited for no insurance, went to court and paid the ticket. The judge did not suspend her license. It has been a couple of months already (I think) since she received the letter asking for $5k for the damages. Her immediate reaction was to just ignore it, let them send the damages to claims and get stuck her credit report (surprise, her credit is complete crap).

She did receive a copy of the police report, which did not include accurate data (i. e. misquoted statement, inaccurate contact information, did not include witness testimony. The witness was some dude on the side of the road who went by the alias of poodle). I convinced her to call the other parties insurance company so she could set up a payment plan, when she mentioned the inaccurate data on the police report, they put her on hold for 30 minutes, then when they did pick up they told her she would be contacted by someone in their legal department, which never happened.

This was probably a month ago. After a week I told her she needed to call them back, assuming that this is one of those things that will come back to bite her in the toosh if she does not act. I also told her to go and talk to the police officer who took the report to see if there is anything they can do (shootin in the dark on that one). Of course she has yet to call them back. I'm not going to hold her hand, so what ever comes from her decisions is on her.

I am curious though, since the judge did not suspend her license in the hearing for the ticket, can it get suspended down the line? I didn't know if my gf ends up just ignoring the situation(sigh), if their attorneys could file charges for the damages and then later get her license suspended for not paying? Or if she ignores them, and it does to court, if she chooses not to set up a payment plan, what happens? At that point will their only option be to stick it on her credit report?
 
Frankly, as a former claims adjuster here in CA, I don't buy the premise that just because she hit him in the rear, she is at fault.

If he cut her off then immediately slammed on his brakes and she could not avoid the accident, it is not her fault. If the liability is questionable, they know it and they are counting on her being intimidated enough to cave in and pay.

Now if she traveled a bit and had the chance to back off to a safe distance and didn't, yeah it's her fault.
 
Judges do not suspend your driver's license. The State Motor Vehicles does.

The DMV will send a letter within a few weeks of learning about the accident. The letter will be sent to the address the DMV has listed on the license. There is a big "do not forward" on ours here from the DMV, so in the worst case, if your GF did not update the address on her license (which sounds plausible if she tends to not take care of business) then the DMV will get the letter back from the post office as "Non Delivered" or similar code. They will then after a period, suspend her license. She will likely find out the next time she is pulled over and gets a $750 ticket for driving suspended.
