Correct me if I'm wrong-

This man applied for insurance in the Fall, when the exchanges started, all exchange policies started 1/1/14. According to the exchange, everything was a go, he paid his premium, he was all set.

He had a heart attack in DECEMBER. Tell me, how could he even have a claim to sue, when his policy wouldn't have even started until 1/1/14.

Please fix any inaccuracies in my reasoning.

The media is just cherry picking parts of this mans story.
So his Obamacare plan started Jan 1st. His prior carrier would cover up to 12.31.13.
Oh wait! He didn't have a prior carrier?
Suck it up buttercup!
 
Based on that article, looks like your reasoning is sound. Carriers don't cover expenses you incur while not covered, plain and simple. If you're paying for coverage from 1/1-1/31 and incur a cost before 1/1, it's not going to be covered.

The comments are incredible on this one. I was just watching them pop up second by second. Outside of the "you're a teabagger/conservative/liberal/***" comments, there seems to be a whole lot of people who don't understand the difference between an "application date" and "effective date".
 
If you go back to the original story instead of the Fox News spin, it does look more like a exchange problem. His surgery was in January, so it should be covered by his new health plan. He signed up for one plan, the exchange said he signed up for a different plan and now neither one of them wants him.
 
This guy moved from peaceful Hawaii to Las Vegas. No wonder he had a heart attack. Hope he at least gets his 2014 bills paid.

It's too bad there are no "Fair and Balanced" news outlets left, if there ever were any to begin with.
 
Thank you, unic...The original is MUCH clearer! It seems this man may have an issue with any charges from Dec 31st. Perhaps under the former "previous condition" exclusions he would have had a subsequent problem, but now he should indeed be covered by the plan he selected and paid his premium for. Any and all charges from Jan 1 on should generate no legitimate issue with payment (within guidelines, etc.) The fact that the system, the exchange, and the administrator are all struggling from this reality is just a symptom which is endemic to the inefficiency with which all entities operate lately. Idiocy rules, common sense is non-existent, and nobody wants to step up to the plate. This man should calmly reach out to his political representatives (lol!) or his state DOBI and really go for broke here...perhaps that type of pressure will force resolution of the issue...
