My agency that I'm currently working for the owner is making me call do not market or do not call leads. Can I get in trouble for this. I asked and had a irritated response saying "this is my agency, my name, my decision"

I am assuming he literally wants you to open a phone and call people. because depending on where they got the leads from. If the customer filled out an info somewhere, anywhere, then there is usually fine print on it that gets telesales past the do not call list.

but... FYI violating the DNC list without written consent is a HUGE issue, I think if someone reports you it is like a $500 fine and that was 10 years ago so it may be more now, plus you could depending on your state get your licensed suspended for doing it.

I worked for someone years ago who made us do the same thing and finally someone reported him and his just paid the fine. Some managers figured if nobody reports you and you make the sales, then the fine is no big deal. But, like I said that was 10 years ago, and even then it was made into a big deal.

Wow that is crazy. This agency is barely writing 20k in premium. There is no way the money is there for a fine! And it could come back on me a my license for sure?

The leads are coming from our CRM system

The FTC, in order to adjust for inflation over the last several years, has raised the civil penalty for certain law violations from the previously large $16,000 amount, to a staggering $40,000. This is a per violation penalty, and adds up quickly when a company has even a minor error spread across a large volume of calls. Among other violations, it appears the $40,000 applies to violations of the FTC's Telemarketing Sales Rule or TSR (including Do-Not-Call violations).

However, let me help you a little bit: You have to really piss someone off to get a legitimate complaint to the FTC about your calls.

There are a few things you can do, but the #1 is to be polite, courteous, and listen.

1) Be a human being and don't sound too scripted or like a radio commercial. Most robocalls are done by dialers and I can't wait to "press 2 to be removed from our list". However, I remember getting calls from this girl who sounded like a commercial... and I kept waiting for the "press 1 to be connected to a live operator or press 2 to be removed"... and it wasn't coming. I had to interrupt her and say "Are you a human being or a recording?" She finally paused long enough to say "I'm a real person." (She was so scripted and animated that I couldn't tell.) And I finally responded "Take me off your list. I don't want these calls. This is your final warning." and I hung up. I never did hear back from them again... but I hated being that person on the phone to begin with. I didn't file an official complaint... but my request was honored.

2) Honor all requests to be removed from your call list and place those numbers on their internal DNC list. (They are supposed to have one, right?) Just say "I apologize. I'll update our records immediately. Thank you." Don't fight with them about it. Just give in, update your records, and dial the next number.

And as long as you aren't calling them 2-3-4-5x a day... you'll generally be okay against a complaint. That doesn't mean you aren't violating the law, but you are being very courteous about how you're going about this.
 
The vast majority of complaints and reports are because people won't take no for an answer.

That said, there are also people out there looking to make money off people like you. I can't say I blame them as the law is pretty clear on this. All you have to do is call the "right" person and you can expect a demand for thousands of dollars to avoid a lawsuit.
 
No... I don't know... I'm curious now... but my best guess would be some kind of SPAM violation. I'm guessing that wasn't it.

No... although it may be that too.. it was the fine you would get over 10years ago when I worked at my college bookstore that sold Tobacco. If you got fought by a secret shopper not carding someone to make sure they were 18. You would get a $500 fine and get fired too.
