They could know that you're using a VPN but how are they supposed to know if you're using it from outside the US or at your local Starbucks?

Technically they can't know you're using a VPN. However, most VPNs resolve to datacenter IP which can be readily identified as such. Netflix, for example, maintains an internal database of IP blocks assigned to hosting companies specifically so they can identify VPNs.

I'm not sure the gov't does this, though there many be commercial services offering such identifications as a service.

But as you say, using a VPN inside the US is not illegal. Might even be wise if you're on some dodgy cafe or airport wifi, though in principle that's what https is supposed to do for you without a VPN. Most people don't really understand what a VPN does, they just see ads and think it makes them more secure or more private.

Regardless, if you get caught, it's career-altering...
