But unless your state in diff, Todd King is right....Monu in Part B2 ask if the client has had diabetes before 18 (im assuming not-so thats a NO) & if client USES oxygen, and in this case thats a NO also, so he would be standard, 1st day coverage!!

This is one of the tough ones. If he didn't smoke, I'm 95% sure he could get immediate with Assurity's WL.
He'll probably do best converting the term to whole and sticking with NYL -- their conversion rates are pretty good.
he can only convert to ther "permanent" life. It's UL, not whole life.
