Group is renewing their group plan dec1 that doesn't have essential benefits, does this screw employees that do not participate in the group plan to qualify for subsidy ,, ie,, "because the group is not offering a qualified plan"

If it is adequate (at least 60% actuarial value) and affordable, then no subsidy will be available to anyone who is ELIGIBLE FOR the plan. Yes, that includes those who waived their rights to the coverage.

You can test it for 60% actuarial value by using the calculator on the cms site. Just google actuarial value calculator.

To be affordable, use the lowest lowest cost plan that the employer offers, which is also 60% or more actuarial value. On this plan, if the premium for self-only coverage (employee-only) is less than 9.5% of the employee's full household MAGI income, it is affordable.

That's known as the "family glitch".
