Commissionable PDP's

Ill keep a list of all commissioned plans that Im contracted with, and if that plan is the best for the client, great.

If there's a better plan not comissionable, I'll let them know which plan is best, then direct them to the carrier to apply.

In terms of agent liability, is that wise?

If you don't write someone what liability issues could you possibly have?

The agent told the Medicare Beneficiary (MB) what to buy.

MB has problems they file a complaint with CMS and/or take legal action against the agent.

Different standard for the agent than for a non-agent saying something like "Hey, check out that cigna plan before you buy a PDP. Ron Van D's approach seems like more defensible from the agent perspective.
 
It also might leave the agent open to a charge of colluding with the carrier and leaves the agent with a much much harder time of proving appropriate review of other options.

For gods sake, please go get an insurance license so you can make these comments from a more informed point of view.

As for liability, it depends on the E&O policy language, other liability insurance carried by the agent, any disclosures or written releases, and whether the agent made what constitutes an actual enrollment recommendation in the first place.
 
Yep, we went from making extra to $70.00/app less. But the FMO's and companies are all happy now so that's all that matters. I've always said I will never retire and just keep my license to collect renewals but shit like this makes me question that more and more every year.
