FL Judge Says His Own Ruling

Actually, I believe that the article is a little misleading. What the judge is doing with this is forcing the Obama Administration to do something. Since the judge issued his ruling a few weeks ago, the administration was doing nothing, hoping to have the clock run-out. The judge is now requiring the admin to take action within the week.

The judge's ruling today is actually very easy to read. He essentially says that the Obama administration clearly knew his declaration was a defacto injunction against further implementation of the PPACA, and that their delay in filing a motion for him to "clarify" his intention was unacceptable. However, since either side may be damaged if the case isn't decided quickly, he is delaying an "injunction" conditional upon the Obama administration filing an appeal within 7 days either to the appellate court or to the Supreme Court. You can read Judge Vinson's recent ruling here: http://graphics8.nytimes.com/packages/pdf/health/20110303-vinson-health-order.pdf

This will be viewed as a victory of Obamacrap. However, this couldn't be further from the truth. Forcing Obama's hand to act, sooner rather than later, which Obama does NOT want.

i find it a bit political for the judge to be acting in this manner. i'm not saying i'm for or against obamacare, just that this judge seems to be really going at this strongly.

I think he is pissed that the Administration is effectively ignoring the courts decision...4 weeks passed and they filed a motion for clarification which is what this thread is all about. The judge is saying that everyone is being hurt by this not being resolved and he will only stay his ruling pending the defendents motion to appeal.

Think about it for a second if the Adminstration does not appeal the ruleing then his decision that it is unconstitutional and struck down the whole law stands as law in his federal district and as such implementation of the law should stop but since the Federal government isn't stopping implementation they are just thumbing their nose at the court.

judges are not supposed to be heroes. they are supposed to interpret the law.

perhaps the attorneys should be deemed heroic for presenting their case so well?

Yes and the Executive Branch is supposed to uphold the law. Have you read the 20 page ruling that judge made recently...the link is listed above.
