According to SCOTUS, the mandate violates the commerce clause but that does not matter since they upheld the ability of Congress to tax.

IOW, just because there is a mandate in place you have the right to refuse to buy health insurance but in doing so you are obligated to pay the tax.
 
It's a tax that is going to make it tough for Obama. But the dirty secret is the tax doesn't kick in to 2016. Max penalty I believe is $618 a year. Reality will be why buy insurance pay the tax untill you need it. Then buy it guaranteed with no pre X.
 
In Plain English: The Affordable Care Act, including its individual mandate that virtually all Americans buy health insurance, is constitutional. There were not five votes to uphold it on the ground that Congress could use its power to regulate commerce between the states to require everyone to buy health insurance. However, five Justices agreed that the penalty that someone must pay if he refuses to buy insurance is a kind of tax that Congress can impose using its taxing power. That is all that matters. Because the mandate survives, the Court did not need to decide what other parts of the statute were constitutional, except for a provision that required states to comply with new eligibility requirements for Medicaid or risk losing their funding. On that question, the Court held that the provision is constitutional as long as states would only lose new funds if they didn't comply with the new requirements, rather than all of their funding.

I thought Liberals were looking forward to their "Free" government Healthcare.....but its a tax? LOL

When the dust settles, this will not be a victory for Obama...he was very clear that the affordable care act would not cost more money and that it is NOT a tax...he will have a hard time spinning this as a victory at the end of the day. He just passed a HUGE tax.

When the dust settles this will be a huge legal victory for Obama but actually he is looking for a big political victory. The latter remains to be seen. Great opportunity for Obama to beat his chest. That has gotta feel good. Then, he starts to say "so it is onward and upward and full speed ahead with Obamacare......." Might want to dial that back a little when you come to that part.

I also understand they lost the ability to force the states to enact the exchanges, state can opt out of ACA which is big. This opinion muddies this further.
