States have always had the ability to opt out. If they do, it'll just be administered by the feds. I'm going by memory, but if they opt out, they lose the ability to receive more money for Medicaid.

I'm trying to read as the info becomes available. They did not rule on this per the commerce clause; ie - whether or not the gov't has the power to "force" people to buy something.

Instead, they issued the ruling based on the government's legal ability to tax.

Simply put; You don't have to buy anything. If you don't you'll just pay a tax.


So in essence, the Supreme Court has invalided the MANDATE in a back-door sort of way? This would still cause the entire ACA to crash and burn..but at a slower pace?

IMHO, they got it wrong.

This is a law that states everyone has to buy coverage. Per the commerce clause, that's unconstitutional.

Apparently SCOTUS said "Not really. You don't have to buy anything. There's no jail time, no criminal charges, etc...you're just choosing to pay a tax instead."

I don't think they are but the market will decide that.

Court said Congress cannot withhold Medicaid funds if the states do not agree to expand Medicaid under Obamacare.
 
Repeal Obamacare?? sorry folks that wont happen. Lets all suck this in and somehow have the gumption to move forward. The Good News is there will be mass confusion in 2014 and everyone will be requied to be insured.
 
If anyone knew their history they would know we went through the same mess in 1963 with Medicare and civil rights.... the Reps through the candidate Goldwater campaigned on repeal... and LBJ easily won.

There were tens of millions of people who hated LBJ because of both Medicare and especially civil rights (no doubt some of the parents or grandparents of members of this venue.) It was a shrill and dirty campaign... anyone remember the little girl and atomic bomb adv?

We're going to see it all again in the next few months. Of course people will say that this is NOT 1964... and I'd say "show me the difference" in how the polls are now, how the campaigns will be run, and what the main issues are.

Romney could win, but my money is not on it. In politics, just wanting it is the the same as having it.

So cry your eyes out. You conservatives lost today and I believe you will lose in November. You are running the wrong candidate. He is the godfather of what was upheld today. Explain how that is a "winner" for you against the Chicago machine?

You state that there were "tens of millions of people" who hated LBJ and medicare etc. And I actually agree with you. If Obama can get things to the point where only tens of millions versus hundreds of millions have an issue with him, then he will do fine. Good luck with that.

Incidently, I have always said that odds favor Obama and still do and the most Romney can do is find an opening and have some things break in his favor. The reality is that Obamacare is a problem that Obama is having to manage now, not a shining opportunity and vote getter. It is a hot poker up his arse that will only get worse. If he can still win, then that is to his favor but he will be working damage control on Obamacare, not winning on it.

As you will recall whole recounting LBJ's success, he declined a second term because he essentially was overwhelmed with vietnam and all these social problems which he was not able to outmaneuver. Obama is finding out what Johnson found out which is that you can maneuver and strategize your way around some issues pretty well and survive for a while but wake up one day and see nothing but wagons circled around you and you cant get out. I am not as sure as you are that Johnson is a great example to make your point. He was a president who declined to even run for a second term because he was so beaten down.

Nevertheless I give Obama the day and a reasonable afterglow period to go with it. Heaven help with the longer term politics on this though. If he can navigate that, then that will be to his credit too, but he already has a dud putting him against the ropes in many polls so he is vulnerable.
 
It's a tax that is going to make it tough for Obama. But the dirty secret is the tax doesn't kick in to 2016. Max penalty I believe is $618 a year. Reality will be why buy insurance pay the tax untill you need it. Then buy it guaranteed with no pre X.

My guess is that you will see open enrollment periods similar to Medicare to cut this down. Still a mess, but I think that will be the way it goes. The plans designs will be regulated like Medicare as well (gold,silver,bronze) and if you are not poor or lower middle class, open up your wallet and listen to the loud WHOOSH sound! For all the talk about protecting the middle class, this bill is a direct attack on the upper middle region and their disposable income.

Fully agree. Battle cries to repeal this are unrealistic. Romney might campaign that he'll overturn it - but he would possess no such power.

However, it's not game over just yet. Now this behomoth has to be funded - meaning they'll gonna have to find a few billion in the couch cushions for the rebates.
